Terms of Service

The Platform is intended for users who are at least 13 years of age. Users under 18 must have verifiable parental or guardian consent before creating an account or submitting personal information. If you are a parent or guardian creating an account on behalf of a minor, you accept these Terms on their behalf and are responsible for their use of the Platform.

By using the Platform, you represent that all information you provide is accurate, current, and complete, and that you have the authority to agree to these Terms.

To access certain features, you must register for an account. You agree to provide accurate registration information and to keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You must notify us immediately at [email protected] if you suspect any unauthorized use of your account. NextPlay Nation is not liable for any loss resulting from unauthorized account access that you failed to promptly report.

You may use the Platform solely for lawful purposes and in accordance with these Terms. You agree not to:

• Post false, misleading, or fraudulent content about yourself or others.
• Harass, bully, threaten, or intimidate other users, especially minors.
• Use the Platform to solicit personal information from minors.
• Scrape, crawl, or systematically extract data from the Platform without written permission.
• Attempt to gain unauthorized access to any part of the Platform or its infrastructure.
• Use the Platform to distribute spam, malware, or unsolicited commercial communications.
• Impersonate any person, organization, or entity.

NextPlay Nation reserves the right to suspend or terminate accounts that violate these restrictions without prior notice.

The Platform allows users to submit profiles, photos, statistics, posts, and other content ("User Content"). You retain ownership of your User Content, but by submitting it you grant NextPlay Nation a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute it in connection with operating and promoting the Platform.

You are solely responsible for your User Content. You represent that you have all rights necessary to grant the above license and that your content does not infringe any third-party intellectual property rights, violate any law, or contain content that is defamatory, obscene, or harmful to minors.

NextPlay Nation may remove any User Content that violates these Terms or that we determine, in our sole discretion, is otherwise objectionable.

NextPlay Nation provides tools for athletes to create public profiles and for coaches, clubs, and recruiters to discover talent. By making your profile public, you consent to it being visible to all registered users of the Platform, including recruiters and sponsors.

NextPlay Nation does not guarantee any recruiting outcome, scholarship offer, or sponsorship deal. All recruiting and sponsorship decisions are made independently by the parties involved. NextPlay Nation is not a party to any agreement between athletes, clubs, sponsors, or educational institutions.

The Platform includes a sponsorship marketplace that facilitates Name, Image, and Likeness (NIL) deals between athletes and sponsors. By participating in the marketplace, you acknowledge that:

• You are solely responsible for ensuring any NIL deal complies with applicable federal, state, and institutional rules and regulations.
• NextPlay Nation is a technology platform and is not a party to, nor does it endorse, any specific deal.
• Sponsors must complete identity verification and comply with all applicable advertising and consumer protection laws.

Certain features of the Platform, including tournament registration and premium subscriptions, may require payment. All fees are stated in U.S. dollars. Payments are processed through third-party payment processors; by submitting payment information you agree to their terms as well.

All sales are final unless otherwise stated. NextPlay Nation may modify its pricing at any time with reasonable notice. Continued use of paid features after a price change constitutes acceptance of the new pricing.

Our collection and use of personal information is governed by our Privacy Rights Policy. We comply with the Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13 without verifiable parental consent.

Parents and guardians may review, update, or request deletion of their child's personal information by contacting us at [email protected].

The NextPlay Nation name, logo, design, software, and all Platform content created by us are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our proprietary content without express written permission.

The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. NextPlay Nation does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by law, NextPlay Nation and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, even if advised of the possibility of such damages. Our total liability for any claim arising from these Terms shall not exceed the greater of $100 or the amount you paid to NextPlay Nation in the twelve months preceding the claim.

You agree to indemnify, defend, and hold harmless NextPlay Nation and its affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Platform, your User Content, or your violation of these Terms.

We may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination will do so.

These Terms are governed by the laws of the State of Indiana, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Platform shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property violations.

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, for material changes, notify registered users by email or in-app notification. Your continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.
